In submitting an application to become an Approved Everything ICT Supplier, whether using the application portal or otherwise, you expressly confirm and warrant that:
- Your organisation or any directors or partners or any other person who has powers of representation, decision or control has not, within the last five years, met any of the grounds for mandatory or discretionary exclusion from the award of public contracts, as set out in Schedule 6 and Schedule 7 of the Procurement Act 2023 which include, but are not limited to the following offences (whether committed within or outside of the UK):
- Corporate manslaughter and corporate homicide
- Offences relating to the counter terrorism act
- Conspiracy to defraud
- Theft or fraud (including fraudulent trading and receiving stolen goods)
- Dishonestly obtaining credit
- Bribery or extortion
- Money laundering
- Slavery and human trafficking
- Participation in organised crime
- Threats to national security
- Misconduct in relation to tax (including tax evasion and tax-related fines)
- Infringement of competition law
- Environmental misconduct
- Insolvency and bankruptcy
- Professional misconduct
- Breach of contract and poor performance
- Acting improperly in procurement
Where one or more of the grounds for discretionary exclusion has been met, please describe the circumstances on a separate sheet.
- Being an individual you are not bankrupt or have had a receiving order or administration order or bankruptcy restrictions order made against you or have made any composition or arrangement with or for the benefit of your creditors or have not made any conveyance or assignment for the benefit of his creditors or appear unable to pay or to have no reasonable prospect of being able to pay, a debt within the meaning of section 268 of the Insolvency Act 1986, or article 242 of the Insolvency (Northern Ireland) Order 1989, or in Scotland have granted a trust deed for creditors or become otherwise apparently insolvent, or are the subject of a petition presented for sequestration of his estate, or are the subject of any similar procedure under the law of any other state;
- Being a partnership constituted under Scots law you have not granted a trust deed or become otherwise apparently insolvent, or are the subject of a petition presented for sequestration of its estate; or
- Being a company or any other entity within the meaning of section 255 of the Enterprise Act 2002 you have not passed a resolution or are the subject of an order by the court for the company’s winding up otherwise than for the purpose of bona fide reconstruction or amalgamation, or had a receiver, manager or administrator on behalf of a creditor appointed in respect of the company’s business or any part thereof or are the subject of similar procedures under the law of any other state.
- Your organisation has not:
- been convicted of a criminal offence relating to the conduct of your business or profession;
- committed an act of grave misconduct in the course of your business or profession;
- failed to fulfil obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which you are established;
- failed to fulfil obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which you are established; or
- been guilty of serious misrepresentation in providing any information required of you under Regulation 23 of the Public Contracts Regulations 2006.
- You are not trading whilst insolvent.
- You have in place (or will commit to putting in place as a prerequisite of being accepted onto the Framework) Professional Indemnity Insurance (services) and/or Public & Products Liability Insurance (goods) with cover of at least £100,000 in respect of any single claim.
- If awarded work under the Framework you will accept without reservation or amendment the relevant obligations set out in the terms and conditions in the framework contract and schedules, as set out within the relevant section of the application portal as if you were a party to that agreement in place of Everything ICT.
- You accept the terms on pricing, Everything ICT fees, invoicing, payment and promotion and the other terms and conditions set out in the documents included on the application portal and in the framework contract and its schedules.
- To the best of your knowledge all information submitted as part of your application is accurate and correct.
I understand that
- the information submitted in our application will be used to assess our organisation’s suitability to supply through Everything ICT as a subcontracted supplier;
- our application may be rejected if we fail to answer all relevant questions fully and completely or if any information provided by us is or proves to be false or misleading; and
- if successful with this application any approval given to our organisation may be removed with immediate effect if any information provided subsequently proves to be false or misleading.
